Terms and conditions

Aastra is holding the following contest:

The contest will begin on April, 15th 2010, and end on October, 30th 2010, at 18:00 hours GMT with one exception - Entries for the student applications will be accepted until November 30th, 2010 to accomodate class schedules. During these time period all contestants duly registered with Aastra and fulfilling the eligibility requirements stated in Article II, below, are entitled to submit XML programs to enter the contest.
For this purpose Aastra will set up a website at www.aastrausa.com/xml-contest where each contestant will register and submit one or more entries in the contest. Contestants must complete and send the entry form on the web page. Upon successful registration, contestants will receive an email with the access data to their account, i.e., user name and password, and will then be able to access to the entire website.
After the contest has ended, the submitted XML programs will continue to be published for one year on the website at www.aastrausa.com/xml-contest and thus keep promoting the recognition of participating programmers.

The XML program must be designed for the XML mini-browser of the 6757i and 6739i Aastra SIP phones. Please refer to the welcome page at www.aastrausa.com/xml-contest for format descriptions, guidelines to be used for entries to be submitted.

Aastra 6757i and 6739i SIP phones could be either purchased from Aastra authorized partners or from the contest sponsor partner. Please refer to the Partners and Sponsor page to get more details.

Contestants agree that submitted applications must differ from those published on the Aastra website http://intecom.aastraintecom.com/xml-contest/competitors2_en.php. Applications that are similar to those published on example page would be rejected. Where an entry is rejected for being similar to the ones already published on the website referred to immediately above, submitter will be informed by Aastra.
Contestants agree to the publication of their XML programs under the terms of the BSD license (see http://en.wikipedia.org/wiki/BSD_licenses). Contestants acknowledge that they will thereby make the source codes available to the public. Anyone may use and modify the source codes, but must retain the copyright notice of the original authors. The source codes can be downloaded from Aastra or a third party provider. If a script language like Perl or PHP is used, a link to a working demo must be provided.
All entries must have been received by 18:00 hours GMT, October 30th 2010. Aastra does not assume any liability for the accessibility of the contest web page or the loss or incompleteness of submitted data.
By submitting an entry in the contest, the contestant agrees to the terms and conditions of participation. The contestant further affirms expressly that by submitting the entry he or she is not violating any rights of third parties and that he or she is the author of the entry, and agrees to hold Aastra harmless in this regard.

The contest is open to all persons who are 18 years of age or older. Employees (and their family members) and agents of Aastra, its subsidiaries of affiliated companies may not enter the contest. This also applies to all companies sponsoring the contest.
No purchase is necessary to enter or win the contest. A purchase will not increase chance of winning. All entries in the contest are subject to these terms and conditions. To be valid, registrations must contain the contestant's name, email address, preferred user name, and home address. The contestant agrees to the storage and use of this data for the purpose of this contest, as set out in these terms and conditions. Contestants may submit any number of entries in the contest; multiple entries are expressly permitted.
Entries are void where prohibited by law.

Best Social Networking & Web 2.0 application: Multimedia Hard-drive / 500 Go
Best Student Entry: $1,000 Scholarship

Winners will be chosen by the jury members listed below.

Several factors will be considered when choosing the winners, including category, the Aastra phone model for which the application was programmed, and various technical requirements. The jury members will test and evaluate the relevance of each application. A prerequisite to participate is that the entry is published under the BSD licenses.

The prizes are expressly limited to the items listed above and do not include taxes, customs duties, gratuities, or any other expense. There is no cash equivalent for prizes, except that Aastra, at its sole discretion, reserves the right to substitute prizes of comparable value or cash. If modifications or substitutions of prizes are made by manufacturers or contractors, Aastra will notify or make such information available to the registered contestants accordingly. A transfer of the first prize in each category to another person is expressly excluded.
By accepting the prize, the winner agrees to assume responsibility for any further actions (like costs) connected with it and exempts Aastra from any liability and claims by third parties. This includes, but is not limited to, claims for injuries and damages and loss incurred by persons and/or property in connection with a prize awarded by Aastra. This also applies to the travel arrangements and accommodations made by Aastra.
The decisions of the jury with respect to the contest are final and not subject to recourse.
The jury is formed from different specialized persons

The winners will be announced on the Internet in November, 2010. Aastra will try to notify all winners by email, but may not be held liable if winners cannot be notified or contacted.

Contestants expressly consent to the publication of their names, and contest entries on the Internet, for the purpose of the contest. Contestants also expressly consent to their applications being made available to interested third parties for demonstration purposes.

These terms and conditions are subject to German law. Contestants otherwise have a right to access, update and delete part or whole of the personal data they provided at the time of their registration.
